Terms of Service | Petalpic

These terms apply when you use Petalpic. By making an image, buying credits or creating an account you agree to them, and to our Privacy Policy and Refund Policy. If you do not agree, please do not use the site. If something here is unclear, write to support@petalpic.com before you buy.

What the service does

You upload a photo (or just describe what you want), pick a style or settings, and an AI image model creates an image from it. Results are generated by AI: they will not always look exactly like the person in the photo or match the examples, and two images from the same photo can differ.

Who can use it

You must be at least 13 years old (or the higher minimum age required where you live) to use the service. If you are under the age of majority where you live, you need a parent's or guardian's permission to buy credits. You are responsible for what happens under your account, so keep your email inbox and your Google or LINE account secure, do not share sign-in links or codes, and tell us if you notice anything you did not do.

Credits and payments

Images are paid for with credits. The credits an image needs are shown before you start it, and they are taken when it starts.
If an image fails, times out, or is blocked by the safety check, the credits are returned to your balance automatically. An image that is finished but that you don't like is not a failed image.
Credit packs are one-time purchases, with no subscription, and do not expire unless the pricing page says otherwise.
Credits from every pack you buy share one balance.
Prices are shown on the Pricing page. Prices and offers may change; the price shown at checkout applies. Payments are processed by our payment provider (such as Stripe).
You can buy credits and make images without an account. A guest's images and the photos used for them are deleted 3 days after they are created; sign in with the email you paid with to keep them.
Credits cannot be transferred to another account or exchanged for cash, except as described in our Refund Policy.

Photos you may upload

Only upload photos that you took yourself or have the right to use, of yourself or of people who have agreed to be in the image. You may not upload or ask for:

Photos of celebrities, public figures or any other person without their consent, or images meant to impersonate or mislead people about a real person.
Photos of anyone under 18, unless you are their parent or legal guardian or have their parent's or guardian's consent.
Any sexual or suggestive content involving a minor, or anyone who appears to be one.
Nudity, sexual content, violence, hate, or content that harasses or bullies anyone.
Content that infringes someone else's copyright, trademark or other rights.
Anything illegal where you live or where the image will be shown.

Requests and images may be checked automatically. We may refuse a photo or a request, remove images that break these rules, and close accounts that repeatedly break them; credits already used are not returned in that case. If you see an image made on this site that uses your likeness without your consent, write to support@petalpic.com and we will remove it.

Using the site fairly

You may not:

Try to get around the safety checks, rate limits or other limits, for example by rewording a blocked request or using several accounts.
Probe, overload, scrape or interfere with the site or the AI providers behind it.
Use the site for fraud, or pay with payment details that are not yours.

Your images

You own the images you make, as far as the law allows, and you may use them for personal and commercial purposes, including posting them on social media.
You keep all rights to the photos you upload. You give us permission to store them, send them to our image providers and process them only to make and deliver your images. We do not use them to train AI models.
AI models can make similar images for different people, so we cannot promise that your image is unique. Make sure your use does not infringe anyone else's rights.
You are responsible for how you use and share your images, including following the rules of the platforms where you post them.
To have an image or photo erased, write to support@petalpic.com.

Our content

The site, its design, the example images and the style descriptions belong to us or our licensors. Please do not copy them in bulk or use automated tools to scrape the site.

Availability

We run the service on a best-effort basis. We do not promise that it will always be available, how fast an image will be ready, or that any style or model will stay on offer. Generation can be slow or temporarily unavailable when AI providers are busy. We may add, change or remove styles, models and features. If we ever close the service, we will tell you in advance so you can download your images.

Disclaimers and liability

The service is provided "as is" and "as available", without warranties of any kind, including fitness for a particular purpose and non-infringement. To the extent the law allows, we are not responsible for indirect, incidental or consequential losses, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived.

Ending your account

You can delete your account at any time in your account settings. We may suspend or close an account that breaks these terms, uses stolen payment details, abuses the service, or puts other people or people shown in images at risk; in that case unused credits from fraudulent payments are removed. Opening a chargeback or payment dispute removes the credits from that payment, and we may suspend the account, so please write to us first.

The sections on photos you may upload, using the site fairly, your images, and disclaimers and liability still apply after an account is closed.

Changes to these terms

When we change these terms we update the date at the top of this page. Important changes will be announced by email or on the site before they apply. Using the service after that means you accept the new terms.
